Publication is a critical concept in copyright statute, since term of copyright often varies by publication status and since date of publication may be used to establish copyright term in the absence of an identifiable creator or author. Broadcast is similarly treated in copyright for phonograms and may soon be extended to all broadcasts in a forthcoming treaty. Many copyright statutes also provide a separate, shorter term of protection, known as a publication right, for the publication itself.
