One or more agents who own rights to the resource.
Usage Note
This is an empty "parent" element to concatenate identification and contact information for rights holders. Enabling users to identify and contact rights holders to facilitate further reuse of resources is an important way to increase visibility and impact for copyright protected resources.

rightsHolder has the following components:
  • Subelements:
    • name
    • role
    • birthDate [seen only in Section: Rights Holder (person)]
    • deathDate [seen only in Section: Rights Holder (person)]
    • affiliation
    • contactInformation


The "type" attribute of "name" identifies whether this name is a Personal Name or a Corporate/OrganizationName. The metadata for each type of name is entered/displayed in separate sections in the Descriptive metadata form.

In the section "Rights Holder (person)", name information is further subdivided and some is gathered under the Group Label: "Rights Holder (person) - Personal Name" on the form. This group contains information from the following subelements of rightsHolder: name, birthDate and deathDate.

Usage Note
Should represent the legal form of the name rather than the popular or pseudonymous form, since the name may be used in official or legal correspondence with the rights holder.

The full or legal name of a corporation, organization, entity or conference.
Usage Note
Prefer the full name. Include the parent organization name for unit names that are not globally unique, e.g., Department of Sociology. Currently, the 'otherInformation' subelement of rightsHolderName is not available for 'corporateName', so add any information, such as Inc., LLC, etc. that are part of the legally referenced name within the 'corporateName' element. Include leading articles if they are part of the legal entity name.

Definition
The role played by the rights holder with respect to the creation, performance or distribution of the resource.
Usage Note
Role is a critical concept in rights, since copyright statute includes related rights (rights of performers, broadcasters, etc.) and since publicity rights, privacy rights, moral rights and rights of indigenous peoples may also apply to the resource. For rights holders with multiple roles (e.g., producer, performer), select the predominant role or the role most applicable to rights management for the resource.

Usage Note
Currently this element is not repeatable, although the option to repeat this data element, with an attribute of "type" for main, work, home and post office addresses is under consideration for future metadata versions. The choice of address is left to the repository, who may prefer the work address that is automatically derived from the organization's directory database or the address that it deems most permanent.

Definition
The date of last verification of the rights holder's current address
Usage Note
Supply the date (YYYY-MM-DD) the contact information is entered into the metadata, or the date the information was verified, whichever is earlier. This date can be used to send automatic update notices to rights holders in order to maintain current contact information. In a future metadata version, as the contact information is re-verified, as the information changes, previous contact information will be written to a rights event to provide a contact "audit trail" for the rights holder.
